These General Terms and Conditions of livom möbelag as seller and you as customer apply to all orders in the Livom online store as well as to those purchases where livom möbel ag declares these GTC to be applicable.
Scope of application
The GTC apply to all services provided by livom möbel ag in the Livom online store and shall apply upon conclusion of a contract. The deliveries, services and offers of livom möbelag shall be based exclusively on these GTC, even if they are not expressly agreed again. By sending an order to livom möbelag you confirm that you have read these terms and conditions and expressly agree to them.
Conclusion of a contract
All information on goods and prices within the ordering process is subject to change and non-binding. Purchase contracts are concluded by acceptance of your order by livom möbelag is concluded. Acceptance of the order will be communicated to you by livom möbel ag via e-mail and is subsequently binding for you. You will also be informed as soon as possible by e-mail of any obstacles to delivery. By placing your order, you confirm that you are aware of the scope and content of your order. Questions in this connection can therefore be clarified with us in advance.
Shipping & delivery
Delivery
The delivery of your sofa is free of charge, provided that access for a 3.5 t vehicle can be guaranteed without additional effort and costs. Delivery is made directly to your living room with 2-man handling.
Terms of delivery
- Special delivery requirements must be communicated in advance, otherwise delivery delays or additional costs may occur.
- Delivery is possible up to the 5th floor without elevator. From the 6th floor upwards, delivery is only possible to the kerbside.
- The maximum carrying distance is 150 meters. If the transport route is longer, this must be clarified in advance.
- If these conditions are not met, delivery may be restricted or additional costs may be incurred.
- As we always work with our motto of sustainability, we cannot take desired dates into account, but we try to include this in our route planning.
Delivery acceptance & inspection of the goods
- Please check the goods for completeness and possible damage immediately upon delivery.
- Defects or transport damage must be documented immediately upon delivery and reported to our customer service within 24 hours.
Not present at the time of delivery
- If you are not present on the agreed delivery date, the goods can be handed over to a neighbor with a written power of attorney. Otherwise, a new delivery will be required, which will incur additional costs.
- If the delivery date agreed with the forwarding agent is not kept or not canceled at least 24 hours in advance, handling costs of EUR 250 will be charged. A new delivery date will only be agreed once these costs have been paid.
Address changes
It is no longer possible to change the address after the delivery date has been agreed. Please check your details carefully before completing the order.
Shipping costs
- We ship free of charge for orders over EUR 500.
- Below that we charge EUR 10.- for shipping.
Delay in delivery
We would like to point out that in certain cases there may be delays in delivery for reasons as yet unexplained. In such situations, no compensation or claims for damages can be made. We endeavor to handle deliveries as smoothly as possible and will inform you as soon as possible in the event of delays.
Prices
All prices on livom are inclusive of the costs listed in the statutory value added tax. The livom möbel ag expressly reserves the right to adjust the prices stated online at any time without notice and without further explanation. The time of the order on the website shall apply to the calculation of prices.
Terms of payment
The following payment options are available to you:
Purchase on account (we reserve the right to carry out a credit check), Paypal and credit card (via Stripe). We also reserve the right to offer prepayment by bank transfer.
In the case of advance payment by bank transfer, the payment period is usually 7 days. If the payment is not received within this period livom möbel ag reserves the right to cancel the order and release the goods for sale again. Any transfer fees are to be borne by you.
Retention of title; offsetting; right of retention
(1) In the case of consumers, we reserve title to the purchased item until the invoice amount has been paid in full. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve title to the object of sale until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
(2) You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or recognized by us. Furthermore, you only have a right of retention if and insofar as your counterclaim is based on the same contractual relationship.
(3) If the customer is in arrears with any payment obligations to us, all existing claims shall become due immediately.
Guarantee and warranty
The guarantee for goods corresponds to generally accepted standards and is 24 months, unless a longer or shorter guarantee period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company address within 10 days of delivery or after the damage has occurred, otherwise the warranty claim will be void. The warranty claim is valid from the date of delivery. It expires in the event of improper use or natural wear and tear. livom möbel ag reserves the right to decide individually in the event of a warranty claim. The guarantee and warranty is excluded for articles that have been declared as outlet goods. The guarantee is based on the respective valid conditions in the guarantee declaration.
Minor model deviations
It may happen that the design of individual items changes slightly. The manufacturer and supplier cannot be held responsible for such modifications. livom möbel ag cannot assume any liability for such modifications.
Care/handling
livom möbel ag assumes no liability for the customer's misconduct in the care and/or handling of the delivered items.
Planting trees
We have two trees planted for each of our products. Each month, an amount is passed on to OneTreePlanted and any other tree partners. Dhe treesare usually planted where they are most urgently needed. Therefore, the buyer's trees are planted at the location where One Tree Planted or another tree planting partner organizes their next tree planting campaign.
Right of withdrawal
Consumers have a statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity (§ 13 BGB).
Cancellation policy
You have the right to cancel this contract for the sofas product group within one hundred days without giving any reason. For all other products (except personalized products), the statutory return period of fourteen days applies.
Personalized furniture and replacement covers cannot be returned. A sofa is considered personalized as soon as it deviates from the standard version on the Livom website. Examples include different colors, different sizes or any individual combinations in the configurator.
In order to exercise your right of withdrawal, you must inform us (livom möbel ag, de@livom.com) of your decision to withdraw from this contract in writing (e.g. by e-mail). If you make use of this option, we will immediately send you a confirmation of receipt of such a revocation (e.g. by e-mail).
Cancellation policy - Valid for orders from 01.06.2025
You have the right to withdraw from the contract within 100 days. The effective shipping costs of up to max. 300 euros will be charged for returns.
For all other products (except personalized products and replacement covers), the statutory return period of 14 days continues to apply.
Personalized furniture and replacement covers cannot be returned. A sofa is considered personalized if it deviates from the standard configuration on the Livom website - for example through an individual color selection, different sizes or adjustments in the configurator.
Consequences of withdrawal
If you withdraw from this contract, we must refund all payments that we have received from you. The refund will be made as soon as the product has arrived in our warehouse and has been checked for possible damage.
For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.
You can arrange the return of the goods yourself or, if you wish, have them returned by livom möbel ag for the sofas product group; the actual collection costs of the forwarding agent will be charged for this, up to a maximum of EUR 300.00. Please inform customer service at de@livom.com if you would like us to collect your order. For all sofa orders from 01.06.2025 onwards, return by forwarding agent collection is free of charge.
Products that are delivered by parcel post must be returned or handed over by the customer at their own expense immediately and in any case within fourteen days of the day on which you inform us of the revocation of this contract at the latest.
You must pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality. We reserve the right to deduct the costs of damaged returns from the refund value.
Right of return category Outlet & demonstration models
Unfortunately, we cannot grant a right of return on demonstration models and outlet products (B-goods).
Privacy policy
livom möbel ag undertakes to process your customer data carefully and to observe the provisions of the relevant data protection legislation. In particular, no data will be passed on to third parties. However, no liability can be accepted for the security of data transmitted via the Internet.
Marketing
livom möbel ag reserves the right to reuse the e-mail address and telephone number provided when ordering for its own marketing purposes (newsletter & other).
Reviews of products
livom möbel ag sends automated e-mails after the purchase, asking customers to rate the purchased products. livom reserves the right to use these as well as all other ratings (without e-mail request) for marketing purposes.
Consent upon creation of a customer account (including Google login)
By creating a customer account – including registration via a Google account – the customer agrees that Livom Möbel AG may contact them in connection with their customer account as well as to provide information, offers and news via email and SMS.The customer may revoke this consent at any time with effect for the future, in particular via an unsubscribe link in the respective messages or by contacting Livom Möbel AG. The processing of personal data is carried out in accordance with the privacy policy of Livom Möbel AG.
General liability
It is hereby expressly pointed out that livom möbel ag cannot be held liable for indirect damage or consequential damage suffered by the customer, insofar as this is not covered by livom möbel ag damage caused intentionally or through gross negligence. In particular, damage resulting from accidents etc. caused by improper handling of the articles is your own responsibility.
Claims for damages by the customer against livom möbel ag are excluded unless livom möbel ag or its vicarious agents have acted with intent or gross negligence.
Change AGB
livom möbel agexpressly reserves the right to unilaterally amend these GTC at any time without prior notice.
Applicable law/jurisdiction
In any case, the relationship between you and livom möbel ag shall be governed by Austrian law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB). The place of jurisdiction is Switzerland. The application of the provisions of the Vienna Sales Convention ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.
